General Terms and Conditions

Format of the Contract

These terms of sale apply to all goods supplied by Jumpsonline.co.uk, a trading name of Plus Retail Ltd , whose office is at Bude Farm, Monkokehampton, Winkleigh, Devon, EX19 8AX (Jumpsonline.co.uk or "we", or "our").
Any order placed by you for goods advertised on our website or via our marketing literature is an offer by you to purchase the goods selected in your order. No contract exists between you and us for the sale of any goods until we have received your order and accepted it (which we may do at our discretion).
We will send you an order acknowledgement shortly after you place your order, notifying you that we have recieved your order. This acknowledgement is not notification that we have accepted your order.
If we accept your order, we will notify you by email or telephone that we have accepted it prior to dispatch of the goods. If we cannot accept your order (for example (but without limitation) because the goods are found to be unavailable) we will notify you by telephone or email.
Sizes and designs of goods being ordered should be checked carefully by the customer to ensure they will meet their requirements before an order is placed as Jumpsonline.co.uk will not be liable to exchange goods that have been ordered incorrectly.

The contract is subject to your right of cancellation (see condition 7 below).
Jumpsonline.co.uk reserves the right to alter prices, colours, designs and specifications at any time should it be necessary to do so.

Availability

Due to the large range of colours, designs and sizes of goods offered, Jumpsonline.co.uk cannot guarantee that goods ordered will be held in stock for immediate delivery as goods are usually tailor-made to order.
During busy times this may result in delivery being anything up to 20 working days, however we will endeavour to deliver within 10 working days of order and payment whenever possible. When you place an order you will be given a more accurate delivery estimate. Delivery estimates will be subject to delay if payment is not received for the order or artwork for personalised items ordered is not provided or signed off.

Pricing and Payment

Prices shown online are broken down per item and a total (including an estimated shipping amount and VAT) will be displayed in your basket. Shipping prices to locations classified as Mainland U.K, incur a delivery charge of £15.00 for orders up to £150 and a delivery charge of 10% of the total order value above £150.
Delivery Charges shown for locations outside mainland U.K. are estimates only. An accurate shipping price will be provided before your order is confirmed.
Any bespoke orders will be priced and agreed with the customer on a case by case basis.

Payment

All prices are in pounds sterling and subject to the delivery charges and VAT as noted above.
Payment will generally be taken when placing your order and all goods must be paid for in full before dispatch or collection.
For larger bespoke orders, a 50% deposit will be taken with the order and the remaining 50% before dispatch or collection.
Payment can be made by paypal, credit or debit card, cheque or by bank transfer.

Delivery

Delivery dates are given as an estimate.
All goods ordered may be collected from the Jumpsonline.co.uk Factory in Devon. Please arrange this when placing an order.
Alternatively, a nationwide delivery service is available via a national courier or Jumpsonline.co.uk’s own vehicle. Please note accurate postal codes are required for courier deliveries.
All deliveries made via courier must be carefully checked and signed for as Jumpsonline.co.uk cannot be liable for any damages or shortages if goods have been signed for as received in full and in good condition.

Returns

You can return any of the goods received to Jumpsonline provided they are unused and in their original condition and packing or packing of similar quality and protection to prevent damage in transit. Any items should be returned within 14 days from the date of dispatch.
Delivery and insurance for returning items to Jumpsonline will be at the expense of the sender. Jumpsonline will refund or exchange the cost of the goods but is unable to refund the delivery charge for dispatching the goods.
If items have been made specifically to order for a client, then Jumpsonline Ltd. has the right to recoup all reasonable expenses involved with designing and manufacturing any bespoke item.
Jumpsonline will not be held responsible for items damaged or lost while being returned to the Company. This returns policy does not affect your statutory rights.

Intellectual Property Rights

You acknowledge that Jumpsonline.co.uk. own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site and the business of Jumpsonline.co.uk (including the structure design and layout of the web site) and assert all such rights worldwide.
You are entitled to use our web site in accordance with these terms and conditions. You must obtain Plus Retail Ltd's prior written consent before you use the web site or any part of it in any other manner.
All persons, individual and corporate, are prohibited from providing hypertext or other links to the Jumpsonline Ltd..co.uk web site, from their own web site or from a third party's web site, without our prior consent.

Liability

Jumpsonline.co.uk attempt to ensure that the information available on the web site at any one time is accurate. However we cannot guarantee that it will be fault free.
Jumpsonline.co.uk does not accept liability for any errors and admissions and reserves the right to change information, specification and description of listed goods, and products at any time.
Jumpsonline.co.uk does not make any warranty that the web site is free from infection by virus or anything else that has contaminating or destructive properties.
Jumpsonline.co.uk does not accept liability for any losses or claims arising from any inability to access the web site, or any failure to complete a transaction.
Jumpsonline.co.uk does not accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of use of the web site for any products or services purchased from the web site.
Jumpsonline.co.uk will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.
Any equine activity by the very nature of the sport entails an element of risk. Jumping has the potential to increase that risk. Jumpsonline.co.uk, its owners and agents assume no responsibility whatsoever beyond the total cost of the purchased product. The Purchaser of the product and subsequent users of the product assume all responsibility for the use of the product up to and including any injury and/or death associated with the use of such product(s).
This liability section applies only to the extent permitted by law.

General

This Agreement does not confer or purport to confer on any third party any benefits or any right to enforce any term of this Agreement.
Jumpsonline.co.uk will not be liable for any delay in or failure to perform obligations if that delay or failure is caused by circumstances beyond their control.
Time shall not be of the essence in the performance of this Agreement.
If for any reason any provision of these terms and conditions is unenforceable, the validity of the remaining provisions shall not be affected.
The terms and conditions and contracts between you and Plus Retail Ltd. shall be governed by English law and all disputes shall be submitted to the jurisdiction of the English courts. Dynamic price calculation maybe unsupported in your browser platform. Final price calculation will be take place in your shopping basket.

Warrantee

Jumpsonline.co.uk produces a product that is built to last reasonable use within the equestrian environment. In the unlikely event that you experience any problems with your jumps, Jumpsonline is committed to rectifying any problems within a timely fashion.

11.1

For Manufacturing Defects

In the event of a manufacturing defect . Jumpsonline.co.uk. offers a two year labour and parts repair warrantee on all new products purchased after 1st January 2010. During this period, Jumpsonline will repair or rectify any problems free of charge.
For items purchased within three months of the defect being reported in writing to us, Jumpsonline.co.uk will pay for the collection and repair of the faulty items.
For Items purchased over three month before the defect being reported, the customer will be required to pay for shipping of the item to and from our factory.

11.2

For Breakages Caused Accidentally in Equestrian Use

In the event of accidental damage. Jumpsonline.co.uk offers a two year labour and parts repair warrantee on all new products purchased after 1st January 2010. During this period, Jumpsonline will repair or rectify any problems free of charge.
For all items purchased, the customer will be required to pay for shipping of the item to and from our factory.

11.3

Warrantee Exclusions

Our warrantee does not include general mistreatment, damaged caused when transporting the jumps between locations or acts of deliberate vandalism. If damage occurs in these circumstances, the customer will be required to pay for any repair costs in additions to shipping costs.

The warrantee does not include scratching or damage to the vinyl transfers applied to panelled products within our range. If customers require replacement vinyl, then these can be purchased at a discounted price upon request.

11.4

Colour Fade

Jumpsonline.co.uk uses the highest levels of colour fasteners and UV protection to offer maximum protection against colour fade of degradation. Jumpsonline.co.uk therefore guarantees all our polypropylene products against significant colour fade for 2 years under normal UV conditions. In the event of a colour fade problem, Jumpsonline.co.uk will replace the effected components of the product free of charge.

Privacy Policy

When you register with or order goods from our Website, you may be required to answer certain questions and provide certain personal information about yourself. In addition, such personal information may be disclosed to us during or as a consequence of our providing services to you. The Data Protection Act 1998 sets out your rights as a consumer in respect of information held about you by businesses.

These terms and conditions are provided to set out clearly the relationship between us. By registering with us and/or using the Website you consent to these terms and conditions. However, this shall not effect your rights in relation to your personal data which are explained below.

1.2 If our business is sold or integrated with another business your details may be disclosed to our advisors and any prospective purchasers and their advisors and will be passed on to the new owners of the business.
